Victim's mother will not testify against Nicholas Ninow on Tuesday

The mother of a seven-year-old girl who was raped inside a bathroom at a restaurant in Pretoria will no longer testify on Tuesday. 

Nicholas Ninow appeared in the high court in Pretoria on Monday and pleaded guilty to rape, possession of drugs and defeating the ends of justice. 

Ninow is accused of raping a seven-year-old girl in the bathroom at a Dros restaurant in Silverton, Pretoria, on September 22, 2018.

Ninow pleaded not guilty to assaulting Dross staff members after they caught him in the cubicle. 

The state called on the childminder who looked after the children at the restaurant to testify on Tuesday. 

Ninow admitted to flushing her panties down a toilet and that he was in possession of a banned substance at the time of the incident. The substance tested positive for CAT. 

Kidnapping charges against the accused have been withdrawn by the state. 

Despite Ninow pleading guilty, the state will continue with the trial with disagreement over his plea argument.

Prosecutor Dora Ngobeni said that the plea explanation does not "sketch out directly how the incident occurred, and as such, the state will continue with the trial".
